Agreement to Terms

By accessing or using the Bloom Local website and services ("Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Services.

Description of Services

Bloom Local provides professional landscaping services including:

• Complete landscape design and installation
• Garden design and plant installation
• Hardscaping (patios, walkways, retaining walls)
• Sod installation
• Fountains and water features
• Outdoor lighting
• Seasonal cleanup

Estimates & Quotes

All estimates and quotes are valid for 30 days from the date of issue. Prices may be subject to change based on material costs, project scope changes, and site conditions discovered during work.

Payment Terms

Standard payment schedule for projects:

• 50% deposit required to schedule work and order materials
• 25% due upon material delivery to job site
• Remaining 25% due upon project completion

Payment may be made by check, cash, or approved digital payment methods. A 3% fee applies to credit card payments.

Project Timeline

Project timelines are estimates and may be affected by weather conditions, material availability, permit requirements, and other factors beyond our control. We will communicate any significant delays promptly.

Warranty

We stand behind our work with the following warranties:

• Plant material: 90-day warranty with proper care and watering
• Hardscaping workmanship: 1-year warranty
• Irrigation systems: 1-year warranty on parts and labor
• Lighting systems: Manufacturer warranty applies

Warranty does not cover damage from neglect, improper care, severe weather, or third-party actions.

Cancellation Policy

3-Day Right to Cancel (FTC Cooling-Off Rule):

If this contract is signed at your residence, you have the right to cancel within three (3) business days from the date of signing with a full refund of any deposits paid. To cancel within this period, send written notice by mail or deliver in person to: Bloom Local, 117 Octavia Drive, Scott LA 70583.

Cancellation After 3-Day Period:

• Before work begins: The 50% deposit is non-refundable but may be applied to a future project within 12 months.
• After work has begun: Customer is responsible for payment of all work completed to date, plus materials ordered or delivered, plus 15% of the remaining contract value as a cancellation fee.
• Customer-caused delays: If the project is delayed more than 30 days due to customer circumstances, Bloom Local reserves the right to adjust pricing to reflect current material costs.

Site Access & Preparation

Customer agrees to:

• Provide clear access to work areas
• Mark or identify underground utilities and irrigation lines
• Remove personal property from work areas
• Secure pets during work hours

Limitation of Liability

Bloom Local's total liability for any claims arising from our services shall not exceed the total amount paid by you for the specific project in question. We are not liable for:

• Pre-existing conditions or damage
• Damage to unmarked underground utilities
• Plant death due to improper care by customer
• Consequential, incidental, or punitive damages
• Lost profits or business interruption
• Damage caused by acts of nature or third parties

Third-Party Services

We may use third-party services including Stripe for payments and other software tools. These services are governed by their own terms and privacy policies. We are not responsible for the actions or policies of third-party providers.

Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

Entire Agreement

These Terms, together with any signed project proposals or contracts, constitute the entire agreement between you and Bloom Local. Any modifications must be in writing and signed by both parties.

Governing Law

These Terms shall be governed by the laws of the State of Louisiana. Any disputes shall be resolved in Lafayette Parish courts.
